Yes, to meet the bear rating you have to lock it. The rubber latches are not enough on their own. A heavy duty spring clip from the hardware store should also work if it has a good load rating.

If you stick with stock, you will still bottom. There just isn't enough upward travel between the axle and the stops. I daily mine and it runs fine on the road. A 2-3" lift will solve the problem and not drastically affect road manners.

I did an AAL, but it only lasted 2 years. I then had Alcans with long travel Bilstein shocks. I can now jump the rig over cattle guards while fully loaded with camping gear and not bottom.

I sleep in the back of the Xterra regularly. I just keep my gear in plastic crates so it isn't bothered by weather when it is outside.

I'm pretty sure you can refuse service to anyone as long as it isn't because they are part of a protected class. I used to moonlight at a gun store and the owner would refuse to sell a gun if he got a bad vibe off the person. No other reason needed.
